1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("You", "your") and Carverse Technologies ("Carverse", "we", "us", "our"), a company incorporated under the laws of India.

By creating an account, accessing, or using the Carverse platform ("Platform"), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Platform.

You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Definitions

• "Platform" refers to the Carverse vehicle service management application, accessible at carverse.in and related sub-domains.
• "Services" refers to all features, tools, and services made available through the Platform, including but not limited to vehicle tracking, service record management, appointment scheduling, invoicing, nearby garage discovery, and community features.
• "User" refers to any individual who accesses or uses the Platform, whether as a Vehicle Owner or Service Provider.
• "Vehicle Owner" or "Owner" refers to a User who registers to track and manage their vehicle's maintenance and service history.
• "Service Provider" or "Provider" refers to a User who registers to offer vehicle services, manage appointments, and create invoices.
• "Content" refers to all data, text, images, and other materials uploaded, submitted, or displayed on the Platform.

3. Account Registration

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• One account per email address. Creating multiple accounts is prohibited.

4. User Roles and Obligations

Vehicle Owners

• Provide accurate vehicle information for effective service tracking.
• Use the platform to manage your vehicle's maintenance history.
• Discover and connect with nearby service providers.

Service Providers

• Provide accurate business information, including valid GSTIN where applicable.
• Maintain professional standards in service delivery.
• Respond to customer inquiries and appointments promptly.
• Comply with applicable business and tax regulations.

5. Acceptable Use Policy

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law.
• Scrape, crawl, or use automated means to access the Platform without our written permission.
• Upload malicious code, viruses, or any harmful content.
• Impersonate another person or entity.
• Post false, misleading, or fraudulent content.
• Attempt to gain unauthorized access to other user accounts or our systems.
• Use the Platform to harass, abuse, or harm other users.
• Interfere with or disrupt the Platform's infrastructure or servers.
• Collect or harvest personal data of other users without their consent.

6. Content Ownership

Your Content: You retain all intellectual property rights in the Content you upload, submit, or display on the Platform. By uploading Content, you grant Carverse a non-exclusive, worldwide, royalty-free license to use, store, and display your Content solely for the purpose of providing the Services to you.

Our Content: The Platform, including its design, features, code, and branding, is the intellectual property of Carverse Technologies. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without our written consent.

7. Third-Party Services

The Platform integrates with third-party services including Google Maps (location services), Supabase (authentication and database), PostHog and Google Analytics (usage analytics), and Sentry (error monitoring). Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third-party services.

8. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We do not guarantee the quality, safety, or legality of services offered by Service Providers listed on the Platform. We are not a party to any transaction between Vehicle Owners and Service Providers. You engage with Service Providers at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CARVERSE TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

Our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Platform shall not exceed the amount you have paid to Carverse in the twelve (12) months immediately preceding the event giving rise to the liability, or INR 1,000, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Carverse Technologies, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of the Platform.
• Your violation of these Terms.
• Your Content or your violation of any rights of another party.
• Your interaction with any Service Provider or Vehicle Owner.

11. Termination

By You: You may terminate your account at any time by deleting your account through the Profile page or by contacting us at support@carverse.in.

By Us: We may suspend or terminate your access to the Platform at any time, with or without cause, including but not limited to:

• Violation of these Terms.
• Abuse of the Platform or other users.
• Payment fraud or chargebacks on a plan purchase.
• Requests by law enforcement.

Upon termination, your right to use the Platform ceases immediately. We will retain your data as described in our Privacy Policy.

12. Data Export and Portability

You may export your data at any time through the Platform's data export features. Upon account deletion, we will retain your data for 90 days to allow for recovery, after which it will be permanently deleted from our systems and backups.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts in [City, State], India.

Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may submit the dispute to binding arbitration under the Arbitration and Conciliation Act, 1996.

14. Amendments

We reserve the right to modify these Terms at any time. We will provide at least thirty (30) days' notice of material changes through:

• In-app notification.
• Email to the address associated with your account.

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Carverse Technologies regarding the use of the Platform, and supersede all prior agreements and understandings.
